Rules for using the Lajoieway platform

1. Purpose
These Terms of Use (hereinafter "ToU") define the terms and conditions of use of the website lajoieway.com and the Lajoieway mobile application (hereinafter the "Platform"), as well as the rights and obligations of the parties.
These ToU are accessible at any time on the Platform and will prevail over any other version or contradictory document.
Use of the Platform implies full and complete acceptance of these ToU.

3. Platform Access
The Platform is freely accessible to any user with Internet access. All costs related to accessing the Platform (hardware, software, Internet connection, etc.) are the sole responsibility of the user.
Account Creation:
To access certain features (booking history, profile management, etc.), users must create an account by providing accurate and complete information. Users agree to maintain the confidentiality of their login credentials.
Availability:
Lajoieway strives to ensure Platform access 24/7. However, access may be temporarily interrupted for maintenance, updates, or force majeure, without engaging Lajoieway's liability.
4. Platform Use
Features Offered:
The Platform allows users to:
- Get a quote for a private car service
- Make a transportation booking
- Manage their bookings and customer account
- Contact customer service
User Commitments:
Users agree to:
- Provide accurate information when booking
- Use the Platform fairly and in accordance with its purpose
- Not attempt to harm the Platform's operation
- Respect Lajoieway's intellectual property rights
Information Accuracy:
Users guarantee the accuracy of provided information (contact details, addresses, number of passengers, car seat needs, etc.). Any incorrect information could cause difficulties in service execution.
5. Prohibited Behavior
It is strictly forbidden to use the Platform to:
- Distribute illegal, defamatory, abusive, or content contrary to public order
- Impersonate another person or create fake accounts
- Attempt fraudulent access to Lajoieway's computer systems
- Collect personal data from other users
- Use robots, spiders, or any other automated system
- Make fictitious or fraudulent bookings
- Resell or transfer access to your account
Any breach of these rules may result in suspension or deletion of the user's account, without prejudice to legal proceedings that Lajoieway reserves the right to initiate.
6. Intellectual Property
Lajoieway's Rights:
All elements of the Platform (texts, images, logos, icons, software, database, etc.) are protected by intellectual property laws.
The "Lajoieway" brand and associated logo are registered trademarks. Any unauthorized reproduction, representation, modification, or exploitation of these elements is strictly prohibited.
License of Use:
Lajoieway grants users a non-exclusive, personal, and non-transferable license to use the Platform, solely for their own transportation service booking needs.
User Content:
Users retain their rights to content they publish (reviews, comments). By publishing them, they grant Lajoieway a non-exclusive, free, and worldwide license to use, reproduce, and distribute them.
7. Limitation of Liability
Lajoieway's Liability:
Lajoieway undertakes to implement all reasonable means to ensure the proper functioning of the Platform. However, Lajoieway cannot be held responsible for:
- Temporary Platform interruptions for maintenance
- Malfunctions due to external causes (network, host, etc.)
- Fraudulent use of the Platform by third parties
- Indirect damages resulting from Platform use
User Liability:
Users are solely responsible for:
- Their use of their account
- The confidentiality of their credentials
- The accuracy of information they provide
- Compliance with these ToU
8. Applicable Law and Disputes
These ToU are governed by French law.
In case of dispute relating to the interpretation or execution of these ToU, the parties will endeavor to find an amicable solution.
In accordance with Articles L.611-1 et seq. of the Consumer Code, in case of dispute, the consumer may use the mediation service offered by Lajoieway free of charge.
Failing amicable resolution, the dispute will be brought before the competent courts within the jurisdiction of the Paris Court of Appeal.
9. Modification of ToU
Lajoieway reserves the right to modify these ToU at any time.
Users will be informed of modifications by:
- A notification on the Platform
- An email to the address associated with their account
Modifications take effect upon publication. Continued use of the Platform after modification constitutes acceptance of the new ToU.
